Virginia Accident Victims Often Have Many Questions...We Have the Answers



Many people are often surprised to discover how hard it is to obtain a fair settlement for their Virginia car accident injuries. The insurance commercials and slogans make it seem like it is easy to recover your losses. After all, they are there for you when you need them most. However, that just doesn’t seem to be the case for many accident victims.

You probably have many questions following your accident. Below are some of the questions we hear most often, along with our answers:

  1. Should I talk with the insurance adjuster? If the adjuster hasn’t contacted you yet, it won’t be long until you hear from him or her. The adjuster works for the insurance company and it is his or her job to look out for the insurer’s interests. There may be questions asked of you that if answered wrongly, could damage your case. It is best to talk with an experienced Virginia personal injury lawyer before speaking with the insurance adjuster.
  2. Do I need to sign the medical authorization? The adjuster will most likely send you a medical authorization. This form is often broad, giving the insurance company access to more information than what is necessary. It would be best for you to get a copy of your medical records first and provide them to the insurance adjuster.
  3. Should I sign the release form? Signing a release form means the end of your claim. If you need further medical care or if there is an injury that later surfaces, you will wish that you didn’t sign the release form. You won’t be able to recover any more money from the insurance company.
  4. Who pays for my medical bills? We recommend that you use your own health insurance policy. It will help you pay the bills while your case is being resolved. You should also check your car insurance policy to see if you have Medical Payments coverage (also known as MedPay). If you are not sure if your policy includes this coverage, contact your insurance agent.
