Too often, the insurance company takes advantage of people before they are ever able to sit down and talk with a Virginia auto accident attorney. We have seen it happen all too often. Even worse, we have heard of some insurance companies that have tried to dissuade individuals from contacting a lawyer before settling the claim. They know they have a better chance of getting these claimants to settle for a "low-ball" offer if an attorney is not involved. What a shame.

Insurance companies are tricky


You want to be able to trust the insurance adjuster who has contacted you and made promises to pay your future medical bills. This person seemed helpful enough and appeared to be genuinely concerned about your injuries. Guess what? To the insurance adjuster, you are just another file that needs to be closed.


Insurance companies use many tactics to get you to the point that you are willing to accept just about any offer that is thrown your way. Some of these tactics include the following:

 

  • Deliberate delay of claims. The insurance company knows that after an accident, you are faced with a mountain of medical bills and may not be working. They are fully aware that you are in a financial bind. By deliberately delaying your claim, they hope that you will accept their low settlement that they eventually end up offering.

 

  • Requesting information that is not necessary. There is a reason why the insurance company will ask for all sorts of irrelevant information before they will "evaluate your claim." The insurance company is trying to stall. While you spend another two or three weeks tracking down useless information, the insurance company is earning interest on the money they should be paying you.

 

  • Disputing your medical treatment. To this day, we have yet to meet an insurance adjuster who has gone to medical school. But, these adjusters still insist on questioning decisions and recommendations made by doctors. After all, their computers say you should be better by now, so you must have been over-treated.

 

  • Nickel and diming the medical bills. The insurance company is in the business of making money. If they are able to cut even 5 percent off each claim that is made, they could hold on to a whole lot more money each year.

 

  • Misrepresenting insurance benefits. It's unfortunate that insurance companies will go as far as misrepresenting the benefits included in the policy. We have seen cases where the insurance company stated the coverage as one amount, only to find out later that there was an umbrella policy.

 

  • Pretending to be your friend. This tactic is used to stop you from hiring a Virginia car accident lawyer. The insurance adjuster might act like he or she is your friend. This person may have made a house call, telling you that the insurance company will pay your future medical expenses. The insurance adjuster is not your friend.



Not every case requires a lawyer's help.


You may or may need a lawyer to represent your case. If your case is small, meaning the injuries were minor and there was little to no property damage, you may be able to handle your claim on your own. However, in some situations, a car accident attorney is just the person you need to ensure that you receive a fair settlement.
